What is a Humanitarian and Compassionate Application

An Humanitarian and Compassionate (H&C) application asks the government to look past normal rules. It is a discretionary tool. This means an immigration officer carefully reviews the whole story of your life in Canada. It is not a standard program or a fast shortcut. Instead, it acts as a safety valve for people with deep ties to the country.

Grandfather with grandchild

An H&C application is not a casual backup plan or a shortcut to permanent residency just because other immigration paths failed. It is a highly discretionary, last-resort measure reserved strictly for exceptional circumstances.

Applying simply because you want to stay in Canada—without proving deep community establishment, the best interests of an affected child, or severe, unmerited hardship upon return to your home country, will result in a refusal. IRCC officers rigorously vet every file, and a lack of compelling, evidence-backed humanitarian grounds means your application will be denied.

Core Factors Evaluated by Officers in a Humanitarian and Compassionate Application

Immigration officers look at three main areas when deciding an H&C case:

  • Establishment in Canada: How well you are settled. This includes steady work, paying taxes, going to school, speaking English or French, and helping in your local community.

  • Hardship upon Return: The extreme challenges you would face if you had to go back to your home country. This might include very poor health conditions, severe economic ruin, or major personal safety worries that do not fit a formal refugee claim.

  • Best Interests of a Child: How a move or separation would deeply hurt any affected children. Officers must give serious, genuine weight to the well-being of young people involved.

What an H&C Cannot Do

It is important to know the strict limits of this process:

  • An H&C does not replace a refugee claim and cannot re-evaluate basic risks like torture or direct persecution if those were already judged.

  • You generally cannot file an H&C if you have a pending refugee claim or received a negative decision from the board within the last 12 months.

Tips for a Strong Submission

  • Show heavy proof: Gather letters from neighbours, tax documents, job records, and medical files.

  • Tell your honest story: Write a clear personal statement explaining why an exception is fair and right.

  • Expect a wait: Processing times are lengthy because every file is read and weighed by hand.

H&C Applications are not the Same as Refugee Claims

Refugee Claim

Legal Focus

Hardship and connection to Canada.: You must prove that being forced to leave Canada would cause unusual, undeserved, or disproportionate hardship, and show how deeply you have integrated into Canadian society.

Fear of persecution in your home country: You must prove you face a direct risk of torture, risk to your life, or cruel and unusual treatment based on race, religion, nationality, political opinion, or membership in a particular social group.

Presence and Timing

Typically used by people who have already lived in Canada for a significant period. The "one-year bar" rule prevents you from filing an H&C application if it has been less than 12 months since your refugee claim was rejected, abandoned, or withdrawn.

Can be initiated the moment you arrive at a Canadian port of entry or from inside the country..

Decision Makers

Decided entirely on paper by an immigration officer working for Immigration, Refugees and Citizenship Canada (IRCC). There is no interview or hearing.

Decided by an independent tribunal called the Immigration and Refugee Board of Canada (IRB) through a formal, in-person hearing.

Current Processing Times

At present, IRCC does not provide standard processing times for H&C applications. While the general wait times used to be between 1 and 3 years, recent changes in Canada's immigration system have seen H&C processing time skyrocket.

If you submitted your H&C application in 2024, it is currently slated to be processed in seven years. If you submitted your application in 2025, the expected wait for processing is currently more than 10 years. There are a few reasons for this exponential increase:

  • Cuts and Annual Quotas: Under Canada’s Immigration Levels Plan, the government has heavily reduced the number of admissions allowed through the Humanitarian & Compassionate pathway. Because there is no legal limit or "cap" on how many people can submit an application, the number of files in the queue vastly outnumber the spaces available each year. Applications are forced to sit in a growing multi-year backlog waiting for an available spot

  • Demand and System Misuse: Due to tighter restrictions and fewer pathways in traditional economic and temporary programs, millions of temporary residents in Canada are looking for any available option to stay. This has led to a massive influx of H&C applications, including many submissions from applicants who do not actually meet the strict hardship requirements.

  • Complex Case-by-Case Assessment: Unlike computerized economic programs that automatically score applicants, H&C files cannot be automated. An immigration officer must read and manually evaluate every piece of evidence, personal statement, country condition report, and factors regarding the best interests of any affected children. This takes a significant amount of time.

  • Two-Stage Processing and Background Bottlenecks: H&C applications require a two-stage approval process. Even after an applicant passes Stage 1 (Approval in Principle), they must go through extensive medical, criminality, and background security checks for Stage 2. These integrity checks are paper-heavy and create additional systemic choke points.

Final Thoughts

Given the reality of shrinking government quotas and multi-year backlogs, an H&C application requires patience, strategy, and meticulous documentation. It is not an immigration safety net for everyone, but for those facing true hardship and holding deep roots in Canada, it remains a vital path forward. Success depends entirely on presenting a rock-solid, evidence-heavy case right from the start.
